A further complication arises from the nearly 50 other businesses that have applied for licenses but are now impacted by this new interpretation of the measurement requirement. The uncertainty caused by this development has left many awaiting final decisions on their application statuses, which could further strain the viability of these businesses.

As it currently stands, dispensaries that are operating can continue to do so with expired licenses as long as they have applied for renewal. To assist affected dispensaries, the state has created a fund offering up to $250,000 to help facilitate relocations if necessary. However, the cannabis office has urged the state legislature to create a permanent solution that would allow these businesses to maintain their current locations, which remains uncertain given that the legislature is not scheduled to reconvene until next year.
