Alongside the increased cap, the budget introduces a new $100 million fund dedicated specifically to independent film and television projects.

The changes mean that production companies frequently working in New York will benefit from heightened payouts. The revised budget aims to address longstanding issues associated with the existing program, such as delays in receiving credits and restrictive measures on eligible above-the-line costs. Notably, the budget extends the film tax incentive program through 2036.

Allocation from the new independent projects fund will have a dual structure: $20 million will be set aside for projects with budgets below $10 million, while $80 million will support larger projects exceeding that financial threshold. Moreover, production entities that apply for two projects in New York with eligible costs reaching $100 million will see a 10% increase in incentives for their next production through 2028.

For qualifying productions, incentive totals could reach as high as 40%, placing New York’s offerings on par with some of the most generous incentives available nationwide. Furthermore, the $500,000 cap on above-the-line costs, which includes salaries for actors, has been removed, allowing productions more flexibility in budget management. Productions will now also have the opportunity to claim credits within the allocation year, which aims to expedite the recovery of credits.

The eligibility criteria for visual effects and animation-only subsidies have been relaxed, encouraging a wider array of creative projects to be realized under the new guidelines. These alterations have been praised by industry leaders; the changes have been termed a “momentous expansion” for New York’s entertainment sector.

This overhaul comes at a time when New York finds itself in a competitive race with other states. California is on the verge of enhancing its film tax incentive cap from $330 million to $750 million, in addition to raising its base credits to 35%. New Jersey has also been ramping up its incentive offerings, adding further pressure on New York to remain attractive to filmmakers and production companies.

Despite the enthusiasm surrounding the new budget, critics of New York’s film tax credit program exist. Analysts from think tanks and some lawmakers argue that the incentives provide a low return on investment, estimating that the state sees only 31 cents in tax revenue generated for each dollar spent on incentives. However, proponents stress that this program is vital for maintaining the competitive edge of New York in the film industry and fostering local economic growth.

Reportedly, New York City has issued 22% fewer location-shooting permits from January to November 2024 compared to the same timeframe in 2022, raising concerns about the state’s position in the film marketplace. This budget proposal, therefore, is seen as a crucial move to restore New York’s struggling film industry.

For the proposal to be implemented, it requires the approval of state lawmakers as part of the wider budget review process. This evaluation timeline is critical, as it is due before April 1st, when New York’s new fiscal year begins.
