The settlement agreement was signed on May 15, 2025, and subsequently filed in federal court on May 22, 2025. This consent order resolves a civil enforcement suit concerning violations of the federal Prevent All Cigarette Trafficking (PACT) Act and local public health regulations.
Investigators conducted thorough monitoring of online purchases, documenting 20 incidents where flavored vape products were delivered to addresses in New York City without the required age verification or mandated product labeling. These observed sales took place between May 2023 and July 2024, raising significant concerns about public health and youth access to these products. Many flavored products marketed by Price Point Distributors feature tastes appealing to children, such as candy and various fruit flavors.
This issue is underscored by the Centers for Disease Control and Prevention (CDC), which reports that 80.6% of e-cigarette sales in the United States are for fruit and candy-flavored vapes. Current regulations in New York City allow only specific flavors—namely tobacco, menthol, mint, and wintergreen—to be sold legally. The consent order specifically reaffirms this regulatory boundary by prohibiting the company from engaging in any transactions involving flavored e-cigarettes intended for delivery to the city.
