New York City takes action against illegal vape retailers.
New York City has permanently closed Price Point Distributors, an online vape retailer, for selling illegal flavored nicotine products. The company’s closure, confirmed by Mayor Eric Adams, is part of a broader initiative to curb the illegal sale of vaping products, especially those appealing to youth. The enforced consent order mandates immediate cessation of all online operations and prohibits future sales of illegal vaping products. This move is part of ongoing efforts to protect public health and restrict minors’ access to harmful products.
New York City has announced the permanent closure of Price Point Distributors, an online vape retailer based in Farmingdale, Long Island. This decision comes after the company was found selling illegal flavored nicotine products that are prohibited under local health laws. The closure is a part of a broader initiative by the city to prevent the illegal sale of vaping products, especially those appealing to youth.
Mayor Eric Adams confirmed that the consent order mandates Price Point Distributors to cease all online operations immediately. Under the terms of this order, the company is also prohibited from engaging in any future sales of illegal vaping products intended for delivery within New York City. Price Point Distributors will face penalties amounting to $1,000 for each illegal sale made, as the enforcement continues to expand against such infractions.
The legal actions against Price Point Distributors stem from a lawsuit initiated by NYC Corporation Counsel Muriel Goode-Trufant in November 2024. The settlement agreement was signed on May 15, 2025, and subsequently filed in federal court on May 22, 2025. This consent order resolves a civil enforcement suit concerning violations of the federal Prevent All Cigarette Trafficking (PACT) Act and local public health regulations.
Investigators conducted thorough monitoring of online purchases, documenting 20 incidents where flavored vape products were delivered to addresses in New York City without the required age verification or mandated product labeling. These observed sales took place between May 2023 and July 2024, raising significant concerns about public health and youth access to these products. Many flavored products marketed by Price Point Distributors feature tastes appealing to children, such as candy and various fruit flavors.
This issue is underscored by the Centers for Disease Control and Prevention (CDC), which reports that 80.6% of e-cigarette sales in the United States are for fruit and candy-flavored vapes. Current regulations in New York City allow only specific flavors—namely tobacco, menthol, mint, and wintergreen—to be sold legally. The consent order specifically reaffirms this regulatory boundary by prohibiting the company from engaging in any transactions involving flavored e-cigarettes intended for delivery to the city.
Additionally, the order encompasses any successor companies or affiliates related to Price Point Distributors, ensuring that the enforcement remains robust and comprehensive. The city preserves the right for future legal actions against the company should violations continue, with any disputes arising from the order set to be resolved within New York courts.
Mayor Adams highlighted the significance of this settlement as a critical measure in the city’s ongoing efforts to restrict illegal products from reaching minors and ensuring public health is safeguarded. The initiative reflects a wider campaign that NYC has undertaken, which includes filing multiple lawsuits against various distributors of illegal flavored vapes. This concerted effort emphasizes the city’s commitment to stringent regulations around vaping products, particularly those that could impact the health and wellbeing of children and adolescents.
